These Terms and Conditions ("Terms") govern your access to and use of the website (domainohost.com), client area, domain registration services, and web hosting services provided by DomainoHost ("we", "us", "our"). By creating an account, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Eligibility and Account Registration

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and purchase services. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Domain Registration Services

• Domain names are registered subject to the policies of the relevant domain registry (e.g., ICANN) and the applicable registrar, in addition to these Terms.
• Domain registration, renewal, and transfer are subject to availability and successful payment; submitting an order does not guarantee that a domain will be successfully registered.
• You are responsible for providing accurate WHOIS/registrant contact information. Inaccurate WHOIS information may result in suspension or cancellation of the domain by the registry.
• It is your responsibility to renew your domain before expiry. We may, but are not obligated to, send renewal reminders. Domains not renewed by the expiry date may enter a grace/redemption period with additional fees, or may be released for public registration.
• Domain transfers in or out are subject to registry rules, including any applicable transfer lock periods (e.g., 60 days after registration or a registrant change).

3. Hosting Services

• Hosting plans are provided on a subscription basis and include the resources (disk space, bandwidth, email accounts, etc.) specified in the plan you purchase.
• We reserve the right to suspend or limit resource usage that negatively affects the performance or stability of our shared infrastructure or other customers.
• You are solely responsible for the content, applications, and data hosted under your account, and for maintaining your own backups unless a backup service is explicitly included in your plan.
• We may perform scheduled maintenance, during which services may be temporarily unavailable. We will make reasonable efforts to notify customers of planned maintenance in advance.

4. Acceptable Use

You agree to use our services in compliance with our Acceptable Use Policy and all applicable laws. Prohibited activities include, but are not limited to, spamming, phishing, malware distribution, hosting illegal content, copyright infringement, hacking or unauthorized access attempts, and any activity that disrupts our network or other users. Violation of the Acceptable Use Policy may result in suspension or termination of your account without refund.

5. Billing, Payments, and Renewals

• All fees are due in advance for the billing cycle selected at checkout, unless otherwise agreed.
• We accept payment through the methods listed at checkout. You authorize us to charge the applicable fees using your selected payment method.
• Failure to pay by the due date may result in suspension of services and, ultimately, termination and loss of associated data or domain names.
• Prices are subject to change; we will provide reasonable notice of any price changes before they apply to renewals.

6. Refunds and Cancellations

Refunds, where applicable, are governed by our separate Refund Policy. Domain registration, transfer, and renewal fees are generally non-refundable once processed, as these are typically non-recoverable costs charged by the domain registry.

7. Suspension and Termination

We reserve the right to suspend or terminate your account or any service, with or without notice, if you violate these Terms, the Acceptable Use Policy, fail to pay applicable fees, or engage in activity that we reasonably believe is harmful to us, our network, or other customers. Upon termination, you may lose access to your data, and we are not obligated to retain or provide backups of terminated accounts beyond any legally required period.

8. Service Availability and Disclaimer of Warranties

We aim to provide reliable services but do not guarantee uninterrupted or error-free operation. Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except where required otherwise by applicable law.

9. Limitation of Liability

To the maximum extent permitted by law, DomainoHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid us for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DomainoHost, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights, including intellectual property or privacy rights.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of DomainoHost or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of our website or platform without prior written permission.

12. Changes to These Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised date, and continued use of our services after such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Kishoreganj, Bangladesh.
